The Tennessee Department of Environment and Conservation (“TDEC”) and Ziptron Energy, Inc. (“ZEI”) entered into an April 4th Agreed Final Order (“AFO”) addressing alleged violations of the Tennessee Underground Storage Tank (“UST”) regulations. See Case No. UST22-0164.
The AFO provides that ZEI is the registered owner of four USTs in Knoxville, Tennessee.
The TDEC Division of Underground Storage Tanks (“Division”) is stated to have performed a compliance inspection at the facility on June 14, 2022. The inspection is stated to have discovered multiple violations. However, prior to the issuance of the AFO, ZEI is stated to have addressed some of the discovered violations, but not others.
Alleged violations are stated to include:
- Failure to operate a petroleum UST in compliance with the relevant Tennessee statute.
- Failure to have overfill prevention equipment that will alert the transfer operator when the tank is no more than 90% full by restricting the flow into the tank or triggering a high-level alarm.
- Failure to cooperate with the Division.
After the AFO was issued, the facility is stated to have submitted documentation showing that the outstanding violations were addressed.
The AFO requires that ZEI not allow any probation violations listed in Exhibit A to occur at the facility for a period of one year from the effective date of the AFO.
A civil penalty of $9,600.00 is assessed.
